By securing a booking or using our Service, you consent to be regulated by these Terms. If you do not accept these terms in full, you should not use the Service.

2. Service Overview

QuietRiverCafe offers elite yacht charter services, which include:

• Daily yacht charters
• Evening boat trips
• Business gatherings
• Personal celebrations
• Extended yacht voyages

Our service availability is conditional on factors such as the weather. We may change or cease services without prior notice.

3. Booking and Reservations

3.1 Booking Process

When you book a charter, you should:

• Be no younger than 18 years old
• Supply full and precise details
• Pay the necessary advance payment as per your booking confirmation
• Adhere to these Terms & Conditions

3.2 Confirmation

Your reservation is only finalized when payment is received and confirmed by us in writing. We can decline service to any client according to our discretion.

3.3 Availability

Availability for charters is governed by boat availability and suitable meteorological conditions. We'll endeavor to accommodate your requested dates and times when feasible.

4. Payment Terms

4.1 Pricing

All quoted rates are in € and are inclusive of taxes, unless stated otherwise. These rates can be altered without prior notice.

4.2 Payment Schedule

• Deposit: Half of the total charter cost is expected at the time of reservation
• Final payment: Due two days prior to the date of charter departure
• Additional charges (if any): Due after the charter service

4.3 Payment Methods

We accept payment via major credit cards, direct bank transactions, and certified bank drafts. Payments are securely processed via encrypted services.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• More than 72 hours before departure: A full refund minus transaction charges
• Between 24 and 72 hours before departure: A 50% refund
• Less than 24 hours before departure: No refund provided

5.2 Weather Cancellations

If the captain determines weather conditions unsafe, we can:

• Reschedule the charter to another suitable date at no extra charge
• Issue a full refund if rescheduling is not viable

5.3 Mechanical Issues

If your scheduled vessel encounters mechanical issues, we will strive to offer an alternate option. If a substitute is unavailable, we will provide a complete refund.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

• Obey all directives from the crew
• Don protective gear as necessary
• Inform us of any health issues that could impact their safety
• Stay within prescribed areas on the boat

6.2 Prohibited Items

These items are not permitted aboard:

• Containers made of glass
• Unlawful drugs
• Weapons
• Excessive quantities of beverages (only moderate consumption allowed)
• Pets (excluding pre-approved cases)

6.3 Conduct

Passengers are expected to act courteously. We retain the right to halt the charter without a refund if passenger conduct poses any risk to safety or interrupts the enjoyment of others.

7. Liability and Insurance

7.1 Our Liability

Our liability is confined to the cost paid for the charter. We are not accountable for:

• Injuries arising due to passenger negligence
• The loss or harm of personal belongings
• Indirect or punitive damages
• Delays brought on by weather or other unforeseen events beyond our control

7.2 Insurance Coverage

We carry full marine insurance that safeguards our fleet and activities. It's the passengers' duty to secure their own travel and possessions insurance.

7.3 Assumption of Risk

By partaking in our charter services, you acknowledge and accept the innate risks associated with marine activities, assuming personal responsibility for your safety and security.

8. Modifications and Itinerary Changes

We may alter itineraries, routes, or schedules due to weather conditions, safety concerns, or operational necessities. We will make all efforts to ensure alternatives of similar value are provided.

9. Force Majeure

Events outside of our authority, such as severe weather, natural catastrophes, governmental controls, harbor discontinuations, and mechanical breakdowns, do not hold us accountable for delays, cancellations, or service adjustments.

10. Privacy and Data Protection

Your privacy is protected according to our Privacy Policy. Engaging with our services implies you consent to the compilation and utilization of your data as detailed within our Privacy Policy.

11. Intellectual Property

The content on our website, including, but not limited to, texts, visuals, logos, and images, are protected by intellectual property rights. Unpermitted replication, distribution, or creation of derivative material is prohibited without express consent.

12. Governing Law

The applicable laws of Spain will govern these Terms. All disputes will be settled in the courts of Barcelona, Spain.
